COMPANIES: "Dovima" and "Dovima Designs" are "Intelligent Design Services" companies. All references to Dovima, Dovima Designs and/or Intelligent Design Services will be referred to herein as the "Company".
CUSTOMER: "Customer" is defined as any person (i.e. individual consumer) or entity (i.e. retailer, wholesaler, business entity, etc.) who places an order through this internet site.
CONTACT/CUSTOMER SERVICE INFORMATION: This internet site (www.dovimadesigns.com) is operated by the Company. Any customer inquiries about this site and/or the site services may be directed, via email, to dovimadesigns@gmail.com.
DESCRIPTION OF SERVICE: The Company currently provides this online internet site to enable the sale of products for consumer use ("Service"). This internet site enables the sale of artistic works in a variety of mediums and on a variety of substrates such as, but not limited to, wall art, wearable art apparel and handbag accessories, home furnishings and jewelry. This internet site further enables the sale of customizable products. Customer understands and agrees that the Service is provided "AS-IS" and that the Company assumes no responsibility for timeliness, deletion, or misdelivery of orders, or the failure to store any user communications or personalization settings.
TERMS OF USE AND CHANGES TO TERMS OF USE: Customer agrees to comply with the Terms of Use for the Service provided through this internet site. The customer acknowledges that the Company may change the Terms of Use from time to time without notice to Customer. Customer acknowledges any changes to the Terms of Use are immediately effective upon being published to this Internet Site.
COLOR ACCURACY: Customer acknowledges that colors in the actual finished product that customer receives may vary from the image/images shown on this internet site or any other internet site location where the Company's artwork, wearable art apparel and accessories may be found. Variances may occur due to monitor settings/monitor calibration, printer variations, and other factors. Customer indemnifies the Company for any costs Customer incurs as a result of variances in color reproduction including, but not limited to, returns, lost income, discounts, and punitive damages.
ARTWORK MATTING & FRAMING: Unless otherwise noted, all giclee prints are sold unframed. Unless otherwise noted, prints are offered matted with a standard white, black or bone 4 ply acid-free matte as specified in the artwork description. Any artwork shown with framing, double matting or any combination thereof is strictly for illustrative/display purposes only. Special orders for custom shipping and framing is available upon advanced communication and agreement as to buyer requirements and buyer's associated additional shipping, handling and materials costs.
ARTIST SIGNATURE: Apparel, stationary, housewares and gift items will show the artist's signature in a digital form upon the item. Giclee, aluminum, canvas and composite wood pieces will be displayed on the website with a digital signature however the artwork itself will be void of digital signature and personally signed. Limited edition pieces will be specified as such and numbered accordingly.
SITE IMAGES: Artwork images shown on this website were sized for display purposes. Artwork produced to fulfill a customer order may therefore appear different from the actual images shown.
PRICING & PAYMENT: Prices stated on this internet site are subject to change without notice. Shipping costs are additional and will be added to your order accordingly (see below for additional shipping information). Prices are not guaranteed for a particular order until the Customer's order has been successfully processed through Paypal.
ORDER CYCLE: Orders will be processed within 24 hours of payment receipt through Paypal. Expect 10 business days for your order to be processed and ready for shipment. Shipping times are additional and will vary in accordance with various shipping methods used. Orders placed during holidays may be subject to extended delivery times. Rush orders may be accepted however the customer acknowledges that additional rush charges may be incurred.
CHANGES TO THE TERMS OF USE: Customer agrees to comply with these Terms of Use, which the Company may change from time to time without notice to Customer. Customer acknowledges any changes to the Terms of Use are immediately effective upon being published to this Internet Site.
EMAIL CONFIRMATIONS: Orders will be processed and followed with an email confirmation. The Company will not be held responsible for email delivery failures.
PRODUCT AVAILABILITY: Product styles, sizes, and availability of apparel and artwork offerings are all subject to change without notice. Product styles, sizes and availability of apparel and artwork offerings are not guaranteed for a particular order until the order has been confirmed.
OFFENSIVE CONTENT: The Company welcomes custom requests. Please note however that the Company reserves the right to refuse any request that may be considered "Offensive Content" by the Company's sole discretion and/or by applicable local, state or federal laws. Offensive content includes, but may not be limited to (1) images and/or text that are obscene, slanderous, deceptive or pornographic, (2) images and/or text that are offensive to or disparing of racial, ethnic, religious or other groups, (3) images and/or text that are inflammatory, (4) images and/or text that is harmful to minors in any way and (5) image and/or text that advocates illegal activities. Customer acknowledges that image customer provides for a custom request is an image that is the sole property of the Customer and Customer is not placing an order for an image that is copyrighted by a third party. If the image is copyrighted, the Customer has secured the right to use said image before an order is placed. Customer indemnifies the Company for any copyright infringement caused by order(s) placed by Customer. Customer indemnifies the Company from and against all claims by a third party and resulting costs for copyright infringement related to Customer's order including, but not limited to, lawsuits, claims, losses, legal costs, court costs, travel expenses, fines, damages, licensing fees and other costs.
CUSTOM REQUESTS: Custom orders are welcomed and will be accepted for processing once the customer and the Company have agreed, in writing, to the specific terms of the customization request; terms will vary according to the details of each request ("Scope of Work") and may be dependant upon a variety of details including, but not limited to, the type of product being requested for customization (i.e. handbag, serving tray, aluminum wall art, etc.), the quality of the image being used, who owns and/or will create the artwork being used for the customization and the unit quantity ordered for that customization and other details that may arise during the course of requirements assessment. Under no circumstances will the Company be responsible for the storage and subsequent retrieval of any customer provided artwork once the initial customer order is fulfilled. The Company reserves the right to remove customer provided art from the Company's computers once the order is complete. Custom orders are non cancellable and non refundable under any circumstances once the Scope of Work has been defined and agreed to, the custom order has been placed and payment has been processed through Paypal.
COPYRIGHT PROTECTION: Customer acknowledges that all content, text, designs, photographs and artistic images on this internet site (www.dovimadesigns.com) are protected by US Copyright laws and may not be copied, photographed, transcribed, reproduced or otherwise recorded in any manner in whole or part at any time without the prior written consent of the Company. Customer further acknowledges that any image the customer provides for a custom request is an image that is the sole property of the Customer and Customer is not placing an order for an image that is copyrighted by a third party. If the image is copyrighted, the Customer has secured the right to use said image before an order is placed. Customer indemnifies the Company for any copyright infringement caused by order(s) placed by Customer. Customer indemnifies the Company from and against all claims by a third party and resulting costs for copyright infringement related to Customer's order including, but not limited to, lawsuits, claims, losses, legal costs, court costs, travel expenses, fines, damages, licensing fees and other costs.
PRIVACY POLICY: The Company respects a Customer's privacy. When placing an order, Customer provides information including Customer's name, telephone number, email address, mailing address, as well as order recipient name, telephone number, email address and mailing address ("Private Information"). The Company will not sell, barter, lease, rent, donate or share User's Private Information. Company will provide customer's Private Information solely to enable the fulfillment of User's Order.
SHIPPING & RETURNS: If your product is damaged in transit, you must contact your shipping carrier directly for damaged goods assessment and disposition. Company recommends shipping damage claims be made immediately upon receipt of goods or as a maximum, within three days of receipt of goods. Note for customers requesting shipment outside of the continental United States of America: Customer is responsible for all shipping costs. If the actual shipping charges exceed the amount stated by this website's automated shipping system calculation, the customer will be notifed of the additional costs and have the right to cancel the order or pay the additional shipping charge via Paypal. Shipments outside of the United States are also subject to customs and legal regulations and will be handled in accordance with governing law of the United States.
